MoveOn.org Civic Action "Save the Internet" Petition Contest Official Rules

The MoveOn.org Civic Action "Save the Internet" Petition Contest ("Contest") begins May 1, 2006, 12:01am Pacific Daylight Time ("PT") and ends on May 8, 2005 at 11:59pm PT (the "Contest Period"). Sweepstakes is sponsored and hosted solely by MoveOn.org Civic Action, P.O. Box 9063, Berkeley, CA 94709 ("Sponsor").

1. Eligibility. Contest is open to current legal residents of the United States and its territories who are 13 years of age or older as of the start of the Contest and who have themselves signed the "Save the Internet" petition ("Petition"). Employees of MoveOn.org Civic Action, MoveOn.org Political Action, or any MoveOn entities, and paid members of the Save the Internet Coalition, are not eligible to participate.

2. How to Enter. Log on to http://civic.moveon.org/save_the_internet/ and follow the directions to sign the petition. You will be asked to enter your relevant personal information, including your name, address, email address, and phone number. You will then receive a confirmation email with your own personalized link that you can forward to friends ("Personal Link"). Forward an email containing your Personal Link to those who share your vision that the Internet should not belong to the highest bidder (if you’ve already signed the Petition, you will receive your Personal Link in an email promoting this Contest). Each time one of your friends clicks your Personal Link during the Contest Period and signs the "Petition", you will receive 1 point. The top ten (10) contestants who collect the most signatures from otherwise qualified individuals ("Signatures") will win an iPod Nano. The remaining top forty (40) contestants who collect the most Signatures will win a $20.00 gift certificate for BarnesandNoble.com.

Please don't spam. We value your privacy and hope that you will value the privacy of others. We'd love to get more Signatures on our Save the Internet Petition, but please remember to exercise good judgment about the friends to whom you send your Personal Link.

In the event of any tie, the contestant who reached the tying number first (based upon Sponsor’s computer records) will be deemed a winner ("Selected Contestant"). Signatures must be collected from U.S. natural persons residing in the U.S., who are at least 13 years of age. Only one Signature per person. Contestants who are found to have either created fictitious persons or who have signed up natural persons more than once will be immediately disqualified and ineligible for any prize, regardless of how many actual Signatures contestant collects during the Contest Period. All signatories to the Petition become members of the MoveOn community and are subject to the MoveOn.org Civic Action Privacy Policy, unless they affirmatively opt out. Contestants must sign up pursuant to these official rules in order to be eligible as a considered contestant. Only those Signatures that come through your Personal Link will be counted toward your total. In the event that multiple contestants send email links to the same recipient, credit will be given to the first contestant whose Personal Link that recipient uses to sign the Petition.

3. Selection and Notification of "Selected Contestants." On or about May 10, 2006, Sponsor will select the top fifty (50) contestants, based upon how many Signatures they have gathered during the Contest Period. Selected Contestants will be contacted by a representative of Sponsor. All Selected Contestants will be required to respond as directed to the phone and/or email notification within 72 hours of attempted notification. The failure to respond timely to the notification may result in forfeiture of the prize and, in such case, Sponsor may selected a contestant with the next highest Signatures. Each Selected Contestant may also be sent an affidavit of eligibility / liability / publicity release (Release). Unless restricted by law, each Selected Contestant will be required to complete and return the Release within the time period specified therein. Selected entrants who are under the age of 18 residents will be required to obtain a parent/guardian signature in order to receive prize. An alternate Selected Contestant may be chosen, from among the remaining eligible contest entrants if a Selected Contestant: (i) cannot be reached; (ii) fails to obtain all signatures on the Release and to return the documents in a timely manner as required pursuant to these Official Rules; (iii) or cannot accept or receive the prize for any reason.

4. Prizes. FIRST PRIZE: Ten (10) first prize Selected Contestants will each receive a prize of an iPod Nano 1GB MP3 player worth approximately one hundred forty-nine dollars ($149.00). SECOND PRIZE: Forty second prize Selected Contestants will each receive a BarnesandNoble.com gift certificate worth twenty dollars ($20.00). Prizes are not transferable. Winners of iPod prize may receive gift card worth $149.00 to purchase iPod player instead of actual iPod. If prize cannot be awarded, a prize of equal or greater value will be substituted, solely at the discretion of Sponsor. Total value of all prizes: Two Thousand Two Hundred Ninety U.S. Dollars ($2290.00).

5. Conditions. Contest is subject to these official rules. By participating, contestants agree to be bound by these complete Official Rules, including Sponsor’s terms of use and privacy policy guidelines. Contestants agree that the decisions of Sponsor are final and binding; and agree to waive any right to claim ambiguity in the Contest or these Official Rules, except where prohibited by law. By accepting a prize, winner agrees to release Sponsor, its attorneys, affiliates, together with the respective directors, employees, officers, licensees, licensors and agents of each, including without limitation, their respective advertising and promotion entities and any person or entity associated with the production, judging, or administration of the Contest (collectively, the Releasees) from any and all liability, loss or damage arising from or in connection with awarding, receipt and/or use or misuse of prize or participation in any prize-related activities. Sponsor reserves the right to use the Contest for publicity purposes in any media, and to use the name, likeness, and hometown name and/or prize information of selected contestants as part of that publicity, without any compensation or prior review unless prohibited by law. Any such use with respect to minors shall be subject to prior approval of parent or legal guardian. Taxes, if any, are the sole responsibility of selected contestants, and selected contestants who are U.S. residents may be issued an IRS Form 1099 for the ARV of any awarded prize. This Contest is outside the US and where prohibited or restricted by law, and subject to applicable federal, state and local laws. Sponsor reserves the right to disqualify any contestant it finds to be tampering with the entry process or the operation of the Contest or violating these Official Rules. The Releasees shall not be liable for: (i) late, lost, delayed, stolen, misdirected, incomplete communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Contest; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Contest, including these official rules. Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest, and reserve the right, in its sole discretion, to cancel, modify or suspend the Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor’s control, corrupt the administration, security or proper play of the Contest. Sponsor may prohibit a contestant from participating in the Contest or winning prize if, in its sole discretion, it determines such contestant is attempting to undermine the legitimate operation of the Contest or undermine the purpose of the petition drive in any way by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass third parties, any other players or Sponsor representatives. Use of any automated system to participate is strictly prohibited and will result in immediate disqualification. Sponsor may disqualify at its sole discretion any Signatures it believes are created by an automated system. Disputes regarding these Official Rules and/or this Contest will be governed by the internal laws of the State of California. Any and all legal actions or claims arising in connection with this Sweepstakes must be brought in a court of competent jurisdiction within the United States. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST OR THE PETITION PROCESS MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

6. Privacy. All personal information collected by Sponsor will be used for the administration of the Contest and in conjunction with the administration of the petition drive, consistent with Sponsor’s privacy policy located at [insert address]. The information provided by Individuals who sign Petitions as is the case here, is treated as public information, such as in the case of this Contest, signed or completed, we treat you’re the name, city, state, and any comments made by those signing the Petition are treated as public information. Sponsor does not make street addresses publicly available, but Sponsor may transmit it to members of Congress and to the President as part of the Petition. This is a standard industry practice in such situations. In no such case will Sponsor disclose an email address or phone number, without permission. Sponsor may also make a signatory’s comments, along with a first name, city and state available to the press and public online.
